Representation and Warranties

•    The User’s request to order products and services from a Partner Merchant by clicking on the ‘Place Order’ tab (or any other button indicating the placement of an order) on the product page with Partner Merchant details on the Platform shall constitute an unconditional and irrevocable authorization issued by the User in favor of tisiy to place online orders for services against the Partner Merchant and the relevant Delivery Partner, on the User’s behalf. An Order, when placed on behalf of the User by Tisiy and accepted by a Partner Merchant, constitutes a separate contract of sale of goods under Law No. 22 of 2004 Promulgating the Civil Code of the State of Bangladesh or any successor legislation between the Partner Merchant and the User, to which Tisiy is not a party.
   

•    The availability of the Platform to the User is solely and absolutely at the discretion of Tisiy. Tisiy does not guarantee that all the features available in the Application will be available on the Website, or vice versa.

•    By using the Services, you agree to the following:

a. You will only use the Services for lawful purposes and will not use them to send or store any unlawful material or for deceptive or fraudulent activities.

b. You will not use the Services to cause nuisance, annoyance, or inconvenience.

c. The information you provide when registering an Account or communicating with us must be accurate, and you will promptly notify us of any changes, providing reasonable proof of identity if requested.

d. You are prohibited from copying or distributing the Software or any content displayed through the Services without obtaining prior written consent from Tisiy.

e. You will keep your Account password and any identification credentials provided by us secure and confidential, ensuring they are not shared.

f. You will not attempt to gain unauthorized access to any part of the Platform, service, account, resource, computer system, or network connected to any Tisiy server.

g. You will not use the Platforms or Software in any manner that could damage, disable, overburden, or impair any Tisiy server or the networks connected to any Tisiy server.

h. You will not conduct any systematic retrieval of data or other content from the Platform, Software, or Services.

i. You will not use the Services or any accessible content for any commercial purpose, including contacting, advertising to, soliciting, or selling to any Service Provider, User, or third-party contractor, unless expressly permitted by Tisiy in writing.

j. You must not create or compile, either directly or indirectly, any collection, compilation, or other directory from any content displayed through the Services, except for your personal, non-commercial use.

k. You will promptly report any errors, bugs, unauthorized access methodologies, or breaches of our intellectual property rights discovered in your use of the Platform, Software, or Services.

l. You will not misuse our promotional or credit code system by redeeming multiple coupons at once.

m. You will not deep link to or integrate with the Platform, nor access it manually or using any robot, extraction software, automated process, or device to scrape, copy, or monitor any portion of the Platform or its content unless expressly permitted by Tisiy in writing.

n. You will not copy any content displayed through the Services, including but not limited to Service Providers’ catalogs and reviews, for republication in any format or media.

o. You will not try to harm other Users, Tisiy, the Platform, Software, or Services in any way.

p. Please note that Tisiy does not independently verify the credentials, representations, or products of merchant partners, including the ingredients and quality of any products, or whether a merchant partner adheres to relevant laws. Buyers are advised to acquaint themselves with the information provided by merchant partners on Tisiy or obtain further details directly from the merchant partners to ascertain quality, reliability, and compliance with applicable laws.

•    By utilizing the Platform in any manner or undertaking any action indicating your acceptance of these Terms and Conditions (including accessing or utilizing the Platform), or completing the Account registration process, you (the User) hereby affirm and warrant the following:

• You have read, comprehended, and consent to be bound by these Terms and Conditions and any future amendments and additions to them as published periodically at https://tisiy.com/  or through the Services;

• You are eighteen (18) years of age or older;

• You possess the legal capacity to enter into a binding agreement;

• You are not prohibited or legally barred from accessing or utilizing the Platform under the jurisdiction in which you reside;

• You possess the authority to enter into this agreement personally and, if applicable, on behalf of any company, organization, or other legal entity you have identified as the User during the Tisiy account registration process, and to bind such company, organization, or entity to these Terms and Conditions;

• Your engagement in using the Services is for your individual, personal, or internal business use. While utilizing the Services, you agree to comply with all applicable laws from your home nation, as well as the country, state, and city in which you are present while utilizing the Services;

• You may access the Services solely through authorized means. You are responsible for ensuring that you download the appropriate Software for your device. Tisiy  bears no liability if you do not possess a compatible device or if you download an incorrect version of the Software for your device. Tisiy  retains the right to terminate your use of the Software and/or Services should you use the Software or Services with an incompatible or unauthorized device.

    SEVERABILITY OF TERMS

If any provision of these Terms and Conditions is held to be unlawful, void, invalid, or otherwise unenforceable, then that provision will be limited or eliminated from these Terms and Conditions to the minimum extent required, and the remaining provisions will remain valid and enforceable.

 DISCLAIMER

Please be advised that under Qatar law, all information, content, products, services, and materials available through the site, whether provided by Tisiy, you, other users, or other affiliates/third parties, including but not limited to orders, submissions, text, photos, graphics  audio files, video, and links, are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied.

To the fullest extent permitted by applicable law, Tisiy hereby disclaims all representations and warranties, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, title, non-infringement, freedom from computer virus, and any implied warranties arising from the course of dealing or course of performance.

It is essential to understand that this disclaimer aligns with the legal requirements in Qatar and aims to ensure clarity and transparency in the terms of service for users who access and utilize the website.

Legitimate Use: Use the service or platform for legitimate purposes only, and refrain from engaging in the purchase or receipt of any illegal materials or fraudulent activities.

Courteous Conduct: Do not use the service or platform to cause harm, harassment, or annoyance to others.

Exchange of Information: Consent to the exchange of information among companies within the platform concerning your transactions and interactions.

Proper Functioning: Refrain from obstructing the proper functioning of the Tisiy platform or attempting to harm it in any way.

Prohibition of Unauthorized Copying: Do not copy or distribute the platform or its content without obtaining written permission from Tisiy.

Account Security: Safeguard your account password or any identification means provided to you and ensure secure and confidential access to your account.

Verification of Identity: Provide all necessary evidence to verify your identity as per Tisiy's discretion.

Right to Refuse Service: Tisiy reserves the right to refuse the provision of services or use of the platform without stating reasons.

As part of Tisiy's policy, users and drivers are prohibited from purchasing, delivering, sending, receiving, or handling the following categories of materials and products:

Prohibited animals and species

Tisiy reserves the right to impose new fees on the use of the platform or service. You are required to pay for the service immediately upon receiving the service.

The delivery service price is determined by distance, and users have the right to review and accept the price before starting the service

Tisiy provides information, recommendations, and services for general purposes only and does not constitute advice.

Tisiy is not liable for any damages resulting from using the website, platform, or service, including damages caused by harmful software or viruses. The responsibility for the quality of services lies with the service provider, and Tisiy is not responsible for any actions, behavior, or negligence of the delivery partner. Tisiy does not provide any express or implied warranties concerning the services. Tisiy, its agents, licensors, and affiliates will not be liable for direct or indirect damages resulting from accessing and using the services or relying on them.
