These T&Cs apply to your use of tisiy.com regardless of the purpose thereof, such as, for example, to shop around, compare prices, get ideas, get inspiration, find out about technical features of the products or services, and/or learn about or understand our value proposition. We strongly encourage you to read these T&Cs carefully. If after reading them you have any questions, please contact us for help.  

It is very important that you keep in mind that, by accessing and using t isiy.com, you are accepting these T&C in full and without reservation, and that they form an inseparable part of both your use of the site and any purchase of goods or services, as well as the scheduling of the latter that you make through the site. Please consider that this does not come from an intention on our part to want to make unilateral impositions. It is an essential quality inherent to the massiveness of the Internet and e-commerce.   AUTHORIZATION OF USE

At its core, tisiy.com is a set of computer applications or software. You can use our software and mobile applications free of charge to visit, compare and purchase, if you wish, the products and services we offer. What you may not do with the computer applications or software on the Site or its mobile applications is to tamper with them, copy them or distribute them. 

Simply visiting the Site does not impose any obligation on you, unless you have unequivocally expressed, through positive actions, your willingness to acquire one or more goods or services, in the manner indicated in these T&Cs.

 ELECTRONIC COMMUNICATION

Any promotional or advertising communication that we send you electronically will have our identity as the sender and will detail the subject line.   DISPATCH AND DELIVERY OF PRODUCTS

If you prefer that we deliver the products to a specific address within the coverage area established by falabella.com, you must indicate the delivery location and the type of delivery from among those available on falabella.com. The site will provide you with information on the cost of delivery broken down by the value of the product, as well as the available delivery locations, and the time range that the delivery or dispatch will take, by clicking on “Home Delivery or Pickup at a physical point”.

Before making the purchase, upon receiving your products, verify that the products correspond to those you purchased and that they are in perfect condition before accepting them. However, if the address change cannot be made, Tisiy.com will not be responsible for what happens to the package nor will it be able to refund the money paid. Please remember that the physical location where the delivery is made must ensure the minimum conditions for access by means of transport, that is, availability of parking and access hours, as well as an elevator when the weight or volume of your purchases makes it necessary.

It is essential that, before purchasing, you check the dimensions of the product, the access to the home and the place where it will be delivered, so that the delivery can be carried out appropriately. If the place of delivery is in a building, for small, medium, or large sized products, delivery to upper floors with or without an elevator will only be made up to the first floor, first floors. In no case is it considered dismantling doors or windows of the customer's home, or to use ropes or other elements to lift the products to upper floors. The products must be received by a person of legal age who must declare their acceptance, leaving a record of their data and any observations regarding the conditions in which they receive the product.

When delivering the order to the address you selected, the delivery person will ask you to indicate the name and ID number of the person receiving the order. Additionally, we may send you an alphanumeric code with which you can validate the delivery of the product without having to indicate this information. Your order may be received by the security personnel or concierge of your building. Please note that, as a security measure, the delivery person may take a photograph of your order outside the address or at the concierge, as appropriate. If at the time of delivery of the product, the customer refuses to receive it for a reason beyond the responsibility of falabella.com, the shipping cost will not be refunded. In the event of a new development because the product is different from the one you ordered, is incomplete or empty, has aesthetic damage or breakdowns, it will enter into an investigation process, and you will have to report it in accordance with the times and conditions established in section 23 of these terms and conditions through the enabled service channels. By providing this information, you authorize the processing of this personal data in accordance with our Privacy Policy. If the User or the person authorized to receive is absent when the order is visited to be dropped off and no one receives it at the place of residence, a notice will be left indicating the time of the visit. During the following three (3) business days after the first attempt, a second attempt will be made to deliver the product to the address. If no one receives the product again, subject to the availability of the transport company, a third attempt will be made, which, if unsuccessful, the order will be cancelled and the refund of the total amount paid by the Customer will be processed.    IDENTITY CONFORMATION TO AVOID FRAUD

tisiy.com will take the necessary measures to safeguard the security of your personal data and your secret key in accordance with current legislation and our Privacy Policy. If changes are detected in the information you have registered on the Site, or in the event of any irregularity in transactions related to your identification or payment method, or simply as a measure to protect your identity, our executives may contact you by phone or email in order to corroborate your data and try to prevent possible fraud. 

If we are unable to establish contact within 72 hours, for your own security, your purchase request made on our Site will not be confirmed. We will inform you by phone or email that your order has been cancelled due to not being able to confirm your identity or the payment method offered. In addition, receipts of the steps taken to contact you and confirm the transaction will be available at our offices for 30 days, so that you can confirm the purchase request. 

  PROCESSING OF YOUR PERSONAL DATA AND PRIVACY POLICY

 The prices offered on tisiy.com correspond exclusively to the price of the product or service offered, taxes included, and do not include transportation, handling, shipping, installation costs (unless you have paid for that service, or it has been expressly included with the purchase of your product), accessories (except those that have been expressly included with the purchase of your product) or others that may be applicable, which will be reported in the shopping cart.  

The Sellers on our platform make their best efforts to ensure that the prices they publish on the Site for their products and services are correct, and this occurs in almost all cases and occasions. However, despite all these efforts, human, or system errors may occasionally occur in the prices published by the Sellers. In relation to the above, we invite you to ensure that your transactions on the Site comply with the good faith that governs contracts in our country.   OFFERS AND PROMOTIONS

Offers consist of offering goods or services at favorable prices or conditions temporarily, in relation to the usual prices of the respective establishment. Promotions, on the other hand, consist of offering goods and services at more favorable conditions than usual, except for those that consist of a simple price reduction.  

The offers and promotions available on tisiy.com are valid only for purchases that involve acts of consumption; that is, those that are intended to satisfy a personal need or that of a family unit. Such trademarks, creations, and commercial images may not be used in relation to any product or service that may cause confusion among customers and in any way that disparages or discredits the Tisiy Companies. Other trademarks that are not the property of tisiy.com and that appear on this site belong to their respective owners. 

No product, image, or sound owned by tisiy.com SAS may be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any purpose, in whole or in part, without the prior written consent of f alabella.com SAS. Likewise, no third party will be permitted to frame or utilize framing techniques to enclose any trademark, logo, or other registered or proprietary information (including images, text, page layout, or form) of tisiy.com without its prior written consent. Nor may you use meta tags or any other "hidden text" utilizing tisiy.com's name or trademarks without the prior written permission of this company.  

tisiy.com is committed to respecting and protecting the intellectual and industrial property rights of its sellers and third parties. For this reason, we offer you a process for handling and managing complaints in the event of a possible violation of intellectual property rights in the products offered by our sellers.     CLAIM TERMS WHEN YOU RECEIVE A PRODUCT WITH AESTHETIC DAMAGE, DIFFERENT FROM THE ONE ORDERED, INCOMPLETE OR EMPTY 

In the event that you receive a product with aesthetic damage or damaged, different from the one you ordered, incomplete or empty, you must report it through the enabled channels according to the times and conditions established below:

You have up to 5 business days from when you receive the product for the following categories:

You have up to 30 calendar days from when you receive the product for the following categories:

@ Musical instruments and accessories.

@ Physical books.

@ Clothing, footwear and accessories.

@ Floor and flooring coverings.

@ Automotive world: tires, accessories, spare parts, add-ons and vehicle batteries.

@ Construction and hardware.

@ Entertainment, kitchen products from Crate & Barrel.

@ Perishable products such as food, beverages, medicines, dietary supplements, vitamins, pet food.

@ Reported as reconditioned, remanufactured or used.

@ Intangible assets and electronic downloads such as licenses.

@ Made to measure and at the client's request, colour paints on request.

@ Previously installed products.

@ Vehicles, motorcycles.

@ Personal care products, sexual wellness, any product that is used in direct contact with the body, such as swimwear, girdles and underwear.

@ Baby health products and accessories.

@ Intimate use, cleaning, consumable or expired products.

The previously established times will be counted from the delivery of your product. Your request will enter into an investigation process, in which evidence will be requested, which must be provided within a maximum period of 24 hours for tisiy.com to continue with the investigation. In the event that you do not make the claim according to the previously mentioned times, you do not provide the requested evidence, or you do not provide evidence in which the fault, the aesthetic damage, different from the one you requested, incomplete or empty is demonstrated, the request will not proceed, the closure of your novelty will be considered notified, and it will be understood that the product was received satisfactorily.

Please remember that the product you reported with any changes such as: cosmetic damage or broken, different from the one you ordered, incomplete or empty. It must be unused, with all its accessories, manuals, original packaging and must be located in the place where it was delivered.
